TERMS AND CONDITIONS
Training Sessions and Memberships
All purchases are non-refundable and non-transferable. All Memberships and individual sessions must be paid in full and are scheduled at the time of sign-up. Membership sessions must be used in full within the scheduled time period of the individual class or membership.
All Participants and Members must be on the mat, ready to train by the session’s regularly scheduled start time to guarantee their class reservation. Pretty Hard Body opens the door for entry 5-10 minutes prior to the start of the training session, unless stated otherwise.. For the safety and enjoyment of all, the doors to the studio are closed to the public, when training’s in session.
Reserved sessions may be cancelled without penalty with a minimum of twelve (12) hours notice in writing to: firstname.lastname@example.org. Cancellations or requests to reschedule (FaceTime clients) received within a minimum two (2) hours of your regularly scheduled start time will result in the forfeiture of the training session or class and will lose the membership session with no option to reschedule.
No Show Policy
Any cancellation received (or not received) within 90-minutes of your class’ start time is considered a no-show and you will be charged a no-show fee of $27 – due prior to your next regularly scheduled class.
If you are a no-show, the remainder of your classes or sessions will be placed on hold until your no-show fee has been paid. All no-show fees are due prior to your next regularly scheduled class.
Featured Training Sessions
From time to time, PHB will have special guest instructors to offer sessions outside of our (PHB) regularly scheduled Signature session calendar. Featured sessions are not included in any Pretty Hard Body training package and are subject to standard session rates ($40, plus additional taxes where applicable). Not including Body Beauty Unlimited members.
Featured Training Session Cancellation
Participants may cancel a featured training session without penalty before 5PM the day before the scheduled session. Each reservation not cancelled before 5PM the day before will result in a fee of up to $27 plus applicable taxes, which will be charged directly to the Participant’s debit or credit card.
Freeze Policy for Package and Series Participants and Clients
Subject to the specific requirements of the State of New York if a Participant or Client is medically unable to attend packaged training sessions, a Participant or Client may request a freeze of Participation (“Medical Freeze”) for the duration of the session’s training dates. In such case, a Participant and Client must provide a doctor’s note at the time of such request. Pretty Hard Body reserves the right to verify the note with the doctor. Participants must notify Pretty Hard Body upon returning from the Medical Freeze by emailing email@example.com. After the Medical Freeze, Pretty Hard Body will resume charging, and Participants and Clients are obligated to pay, the Participant’s and Client’s outstanding payments until any commitment period has expired. Medical Freeze requests should be sent via email to firstname.lastname@example.org. Any non-medical freeze requests should also be sent via email to email@example.com. Pretty Hard Body reserves the right to adjust the Participant and Client freeze policy from time to time. Freezing participation for any period of time does not relieve the Participant and Client from any minimum monthly participant commitment, as may be required for certain types of training packages.
UNLESS OTHERWISE STATED BY PRETTY HARD BODY, LLC IN WRITING, RECURRING TRAINING PACKAGE CHARGES WILL BEGIN AT THE TIME OF PURCHASE AND RECUR BI-MONTHLY UNTIL CANCELLED BY THE CLIENT IN ACCORDANCE WITH OUR CANCELLATION POLICY STATED ABOVE. PARTICIPATION BEGINS AT THE TIME OF PURCHASE (AND NOT AT THE TIME OF THE PARTICIPANT’S FIRST TRAINING SESSION OR TRAINING SERVICE). THE BI-MONTHLY PAYMENTS WILL BE CHARGED AUTOMATICALLY AND ON APPROXIMATELY TWO WEEKS FROM THE DAY THAT THE PARTICIPATION COMMENCED AND ORIGINAL PARTICIPATION PAYMENT WAS MADE (the “Billing Date”).
Billing dates cannot be moved to a different day of the month. If payment does not process successfully, the Participant and Client will automatically become inactive until payment is made. Any lost time that results from payment processing failures will not be reimbursed or credited. All deposits and payments are always non-refundable and non-transferable.
Cancelling participation before the end of the commitment period does not relieve Participant of payment through the commitment period.
Pretty Hard Body collects NYC sales tax on taxable credits, memberships, and other products in New York. Prices shown reflect NYC local taxes.
Payment Obligations of Participants and Clients
All payments and deposits are non-refundable and non-transferable. Participants and Clients shall not be relieved of the obligation to make payments agreed to, and no deduction from or reimbursement of any payment shall be made, because of Participant’s and Client’s failure to use Pretty Hard Body’s facilities. In other words, Participants and Clients must continue to pay the rate agreed upon for the duration of the Training package or Series regardless of the number of training sessions attended. Participants and Clients will not be reimbursed or credited any unused sessions in the period allotted for the package or Series purchased. Pretty Hard Body reserves the right to increase its training/package prices from time to time.
Form of Payment
All payments (including all training sessions, packages, series, early booking, and incidentals) are payable by electronic funds transfer from Participant’s and Client’s credit card account or debit card account for an additional merchant processing fee of 2.9% + 0.25 or payable by an ACH bank transfer for free. Payments for Training packages and series or individual training sessions may not be split between multiple cards, and processed payments may not be refunded in order to charge payment to a different card.
Returned Payment Penalty
Participants and Clients will automatically be charged any bank fee imposed on Pretty Hard Body, plus a processing fee of up to $35 for any returned payment due to closed accounts, insufficient funds, or any reason. If this occurs, Pretty Hard Body retains the right to collect the current and past due balances in any month after the returned payment.
Disputed Charge Penalty
In the event that a Participant and Client initiates a credit card dispute that is subsequently resolved in Pretty Hard Body’s favor, Pretty Hard Body shall have the right to charge the Participant and Client up to $50 per occurrence. Participants and Clients who dispute a valid charge for a late cancellation or no-show will be subject to this $50 fee.
Change in Operating Hours/Temporary Closing of Facility
As a result of repair, maintenance, special occasions or events, holidays, acts of God (such as a heavy snow storm), or for other reasons, Pretty Hard Body may elect to restrict the use of or temporarily close its facilities or activities from time to time. There will be no reduction, suspension or reimbursement of Participant or Client payments during such time nor extension of a participation period as a result of any temporary closing. Also, hours of operation may be amended from time to time, and certain services or programs may be added or eliminated from time to time, at Pretty Hard Body’s sole discretion. From time to time, Pretty Hard Body may offer special promotions or offers. When such promotions or offers arise, please refer to the specific promotion details for any terms that may differ from these Terms and Conditions.
CONDUCT, RISKS AND SAFETY
Participants and Clients shall not use any Pretty Hard Body facility, service or equipment in such a way as to endanger the health or safety of themselves or others. Participants and Clients shall be responsible for any property damage or personal injury caused by themselves or their guests. Participants and Clients agree not to violate any laws while in Pretty Hard Body facilities.
Revocation of Participation and Credits
Pretty Hard Body, in its sole discretion, may revoke Participation or Credits at any time and without refund, in the event that a Participant or Client engages in behavior that is unsafe or objectionable to any other Participant, Client or staff, or for reasons of nuisance or disturbance to any other Participant, Client or staff, moral turpitude, fraud, personal hygiene or attire. Pretty Hard Body also reserves the right, in its sole discretion, to require a Participant or Client to leave for the day if, in Pretty Hard Body’s reasonable judgment, a Participant or Client poses a health or safety risk, or is disturbing or is likely to disturb any other Participants, Clients or staff.
Medical Recommendations and Disclaimer
Participants should consult with their physician or have a physical examination before using any of Pretty Hard Body’s facilities or enrolling in any training session, especially if the Participant is elderly, pregnant, has a prior injury, has a history of heart disease, high blood pressure or other chronic illness, is unaccustomed to physical exertion or has other physical limitations. Participants acknowledge that Pretty Hard Body makes no claims as to medical or fitness results that can or may be obtained through use of the Pretty Hard Body’s facilities, equipment or services. Pretty Hard Body has neither suggested nor will suggest any medical treatment to Participants. Only licensed medical professionals are qualified to give medical advice.
Any strenuous athletic or physical activity involves certain risks. Participants and Clients assume the risk of any and all accidents or injuries of any kind that may be sustained by, or in connection with, use of Pretty Hard Body’s facilities. Pretty Hard Body cannot guarantee that any facility or equipment is free of risk. Participants and Clients agree to exercise care in the use of Pretty Hard Body’s facilities, equipment and services to protect against accidents.
Loss of Property
Pretty Hard Body shall not be liable for the disappearance, loss, theft of or damage to personal property (including money, jewelry, or other valuables).
Cellphones are prohibited in Pretty Hard Body training sessions unless prior permission has been granted by a studio manager due to exceptional circumstances.
Pets and Bicycles
Pets, except service pets, and bicycles are not permitted in Pretty Hard Body facilities, unless otherwise stated by the studio.
Proper athletic attire is required. Socks must be worn in the studio. Athletic shoes that have not been worn outside of the studio, and/or athletic shoes with clean soles that are free of debris, are required for Pretty Hard Body small group, private and duet training sessions. Pretty Hard Body reserves the right to make the final determination in its sole discretion with regard to appropriate attire.
Pretty Hard Body may from time to time reserve the use of its facilities for special events, and private functions.
Pretty Hard Body does not discriminate against any person because of gender, race, creed, age, color, sexual orientation, national origin or ancestry with respect to participation in Pretty Hard Body training or activities. Last Updated: July 25, 2019
